1. Purpose

These Terms of Service (ToS) govern the use of the Homeforswap platform, accessible at homeforswap.com and published by [Company name], SIREN [XXX], registered office at [address].

2. Acceptance of terms

Use of the site implies full acceptance of these ToS. The user acknowledges having read and accepted the ToS at the time of registration.

3. Service description

Homeforswap is a matchmaking platform allowing its members to swap their homes. The platform is not a party to the contracts concluded between members.

4. Registration

Registration is free. The user undertakes to provide accurate information and keep it up to date. Each member is responsible for the confidentiality of their password.

5. Members’ obligations

  • Respect other members and the community;
  • Publish honest and complete listings;
  • Do not use the platform for commercial purposes (rental, subletting, etc.);
  • Do not publish illegal, defamatory or discriminatory content;
  • Keep the exchanged home in good condition and respect the rules set by the host.

6. Subscriptions and payments

Paid services are billed in euros incl. tax. Payment is made online by credit card. The subscription does not auto-renew.

7. Right of withdrawal

Pursuant to article L221-28 of the French Consumer Code, the right of withdrawal does not apply to services fully performed before the end of the withdrawal period, which is the case as soon as the user starts actively using the paid services.

8. Platform liability

Homeforswap cannot be held liable for direct or indirect damage arising from exchanges between members. The platform is a technical intermediary.

9. Moderation and suspension

We reserve the right to suspend or delete any account that does not comply with these ToS, our privacy policy or the applicable law.

10. Intellectual property

Content published by members remains their property. By publishing on Homeforswap, members grant the platform a non-exclusive right of use for the duration of their subscription and for site promotion purposes.

11. Personal data

Personal data processing is governed by our Privacy policy.

12. Applicable law and jurisdiction

These ToS are subject to French law. Any dispute will be brought before the competent French courts.
